This Privacy Policy describes how Shasta Street LLC, trading as Budget 420(“we”, “us”, “our”), collects, uses, retains and protects the personal information of customers (“you”) of our website and delivery service. We are a licensed California cannabis delivery retailer and our service is restricted to adults aged 21 or over.
1. Information We Collect
Age and identity verification.To confirm you are 21 or over, as California law requires, we collect an image of a government-issued photo ID (such as a driver’s licence, state ID or passport) and your date of birth. This is used solely to verify your age and identity and to satisfy our record-keeping obligations as a licensee.
Delivery information. Your name, delivery address, phone number, email address, order contents, order date and time, and any delivery instructions you give us.
Account information. The contact details you provide when you register, and your order history with us.
Consent records. Where you opt in to text messages, we record the date and time of your opt-in, the exact consent wording shown to you, and associated technical metadata such as IP address and browser type, as evidence of consent.
2. How We Use Your Information
Age verification. To confirm your age and identity before you can place an order, and to meet our obligations as a licensed retailer.
Fulfilling your order. To process, prepare and deliver your order, and to contact you about it. Your name, address and phone number are shared with the delivery driver assigned to your order.
Customer support. To respond to your enquiries.
Marketing.Where you have opted in, to tell you about products, offers and promotions. You can withdraw this consent at any time — see “Your Choices” below. Marketing is never a condition of purchase.
3. SMS / Text Message Program
Program overview. Budget 420 operates an SMS messaging program that sends two separate categories of message:
- Service / transactional messages — order confirmations, delivery status updates, driver-on-the-way notifications, and customer-support replies.
- Marketing / promotional messages — offers, product announcements and special deals. These are sent only to customers who provide separate, independent consent.
How you opt in. Opt-in is collected exclusively through the web forms on this website. There is no keyword-based opt-in, no point-of-sale collection, and no third-party list acquisition. The registration form provides two separate, optional consent checkboxes — one for service/transactional messages and one for marketing/promotional messages.
Neither checkbox is pre-selected, and both are optional, so the form can be submitted without either. Consent is not a condition of any purchase.
We record the date and time of opt-in, the consent language you agreed to, and associated technical metadata as evidence of consent.
Message frequency. Message frequency varies by your activity. Service messages are sent in response to orders you place. Marketing messages are sent only to customers who separately opted in to that category.
Fees. Message and data rates may apply to messages sent to and from you, depending on your mobile carrier plan.
Opt-out and help. You may cancel the SMS service at any time by replying STOP, END, QUIT, CANCEL, UNSUBSCRIBE or OUT to (916) 212-8785. You will receive a confirmation message and no further texts will be sent. For assistance, reply HELP.
Age requirement. Participation in the SMS program is limited to U.S. recipients aged 21 years or older, consistent with California law for adult-use cannabis.
Data handling. Text messaging originator opt-in data and consent are not shared with any third parties, except for aggregators and providers of the text-message services required to transmit the messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories mentioned in this policy exclude text messaging originator opt-in data and consent; this information is not shared with any third parties.
4. Data Sharing and Third Parties
We do not sell, rent or trade your personal information. We may share information with trusted third-party service providers — such as website hosting, delivery drivers, payment processing, analytics, and our customer relationship management (CRM) platform — solely so they can perform services on our behalf. These providers are contractually obligated to keep your information secure and confidential.
As stated above, text-messaging opt-in data and consent are excluded from all such sharing and are never shared with third parties for marketing.
We may also disclose information where required by law, or to the California Department of Cannabis Control and other regulators in connection with our licence.
5. Data Retention
Identity verification documents. We retain verification documents only for as long as necessary to verify your age and identity and to meet our record-keeping obligations as a licensed retailer, after which they are securely deleted.
Delivery and order information. Retained for as long as necessary to fulfil your orders, provide support, and comply with our legal and regulatory obligations.
Account and contact information. Retained for as long as you maintain an account with us.
Consent records. Retained for as long as we may need to evidence your consent, and after it is withdrawn where required to demonstrate compliance.
6. Your Choices
You can withdraw marketing consent at any time by replying STOP to a text message, using the unsubscribe link in an email, or contacting us directly. Withdrawing marketing consent does not stop service messages about an order you have placed.
California residents may request access to, correction of, or deletion of their personal information, and may request that we not sell or share it. We do not sell personal information. To make a request, contact us using the details below. We will not discriminate against you for exercising these rights. Some information must be retained where the law requires us to keep it.
7. Data Security
We take reasonable measures to protect your information from unauthorised access, use or disclosure, including access controls, encrypted connections, and restricting verification documents to authorised staff only. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
8. Data Storage Location
All data we collect is stored on servers located within the United States.
9. Children’s Privacy
Our service is not intended for anyone under 21. We do not knowingly collect personal information from anyone under that age. If you believe someone under 21 has provided us with personal information, please contact us and we will delete it.
10. Changes to this Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page with a revised date. Your continued use of the service following any change constitutes acceptance of the revised policy.
